The rules and conditions for using PocketPaw

🆕 Notice for Existing Users. This is Version 2.0 of our Terms of Service and is a material update from Version 1.0 (dated 19 April 2026), reflecting the new features released with the PocketPaw v2.0 app (PawMunity, PawPRO / PawRadar 2.0, Walk / Hike GPS, PawTime, PawMail, Growth Marks, Referrals, multi-platform sync to Android and Web). If you registered before 23 May 2026 and only accepted Version 1.0, you must accept this Version 2.0 in the app before you can continue using the v2.0 features. New users joining on or after 23 May 2026 accept Version 2.0 directly during sign-up.

Please read these Terms of Service ("Terms") carefully before using the PocketPaw service on iOS, Android, or the web at pocketpawapp.com (collectively, the "Services") operated by NextPath Solutions Limited ("PocketPaw", "we", "us", or "our"), a company incorporated in Hong Kong.

By creating an account or continuing to use the Services on or after the Effective Date, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (Version 2.0), and our Community Guidelines & Moderation Policy (Version 2.0). If you do not agree, you may not access or use the Services.

1. Eligibility

1.1 Age. You must be at least 13 years of age (or the higher minimum age in your jurisdiction — see our Privacy Policy, Section 10). If between the minimum age and the age of majority, you must have a parent or legal guardian's consent.

1.2 Legal capacity. You represent and warrant that: (a) you have legal capacity to enter into a binding agreement; (b) you are not prohibited from using the Services under any applicable law; (c) you will comply with these Terms and all applicable laws.

1.3 Geographic availability (v2.0). PocketPaw v2.0 is offered exclusively in Hong Kong and Canada on the Apple App Store. In-app scaffolding (region enum, multi-language support) covers New Zealand, Australia, Singapore, and Malaysia in anticipation of v3 launch, but no new App Store regions are added in v2.0. We have no plans to launch in the European Economic Area at this time.

1.4 Future regions. When we expand to v3 markets, the Services will become available in additional jurisdictions; your account will become subject to any region-specific addenda we publish at that time.

2. Account Registration & Security

2.1 Registration. Register via Firebase Authentication using a valid email + password, Sign in with Google, or Sign in with Apple (the latter currently iOS only).

2.2 Account security. You are solely responsible for: (a) confidentiality of your credentials; (b) all activity under your account; (c) notifying us immediately of any suspected unauthorised access or breach at support@nextpath.hk.

2.3 One account per person. No multiple accounts for deceptive purposes or to circumvent any suspension. No account sharing or transfer, except that a Business / Service Provider account may be operated by authorised personnel of the business.

2.4 Account types. - Dog Owner (default) — individual users. - NGO — registered non-governmental or charitable organisations engaged in animal welfare; eligible to post Adopt listings; inherits free PawPRO+ entitlement. - Business / Service Provider (PawPRO / PawPRO+) — vet clinics, groomers, dog walkers, pet shops, dog cafés, boarding facilities, daycares, dog trainers, dog sitters, online stores, and other dog-related businesses.

2.5 Dog profiles (PawFile). Each Dog Owner account has one PawFile in v2.0 (multi-pet support is planned for a future major release). You are responsible for the accuracy of all information you provide.

3. Multi-Platform Account & Subscription Identity

3.1 One account, three platforms. Your PocketPaw account is the same on iOS (current), Android (planned v3), and Web (read-only PawPicks today; business backend in v3). Your data, including your PawFile, PawHub records, PawMunity activity, and subscription entitlement, syncs across all platforms via Firebase as the single source of truth.

3.2 Server-authoritative entitlement. Feature access (PawVIP, PawPRO, PawPRO+) is gated by server-side entitlement, not by "this device bought it". If you subscribe on one platform, the entitlement applies on every platform where you sign in to the same account.

3.3 Per-source records. We record subscriptions with a source tag (apple, google, stripe, manual, or referral). The effective entitlement is the latest active across all sources. Buying on one platform does not wipe an entitlement from another.

3.4 Anti-steering compliance. Within the iOS app we do not direct you to buy elsewhere. You may always choose where to subscribe; cross-platform recognition is automatic.

3.5 Sign-in availability across platforms. Sign in with Apple is iOS only; for the cleanest experience across iOS, Android, and Web, we recommend using email + password or Sign in with Google.

4. User Content & PawFile

4.1 Ownership. You retain ownership of original User Content (photos, bios, forum posts, comments, reactions, event listings, messages, PawMail items, product reviews, business reviews, PawTime card reviews, Dog Park reviews, Growth Marks photos, Walk / Hike records).

4.2 Licence to PocketPaw. Except for (i) PawPicks product listing data and (ii) PawTime card definitions (each governed below), you grant PocketPaw a non-exclusive, worldwide, royalty-free, sublicensable, transferable licence to use, store, display, reproduce, adapt, and distribute your User Content for the operation, improvement, and promotion of the Services. This licence terminates on deletion of content or account, subject to backup retention; PawPicks reviews and PawMunity public posts with community responses are anonymised rather than deleted.

4.3 Public PawFile sharing. When you share your PawFile via a public link or via the "Share to PocketPawApp.com" toggle, anyone with that link (including non-users) can view the profile, subject to your per-field public/private toggles. You can make your PawFile private at any time in Settings.

4.4 Your representations. You warrant you have rights to all User Content posted; it does not infringe third-party rights; it complies with applicable law and these Terms.

4.5 Content removal. We may remove violating User Content at any time. Auto-takedown thresholds (≥3 reports → automatically hidden pending admin review) apply to PawPicks products, PawMunity posts, PawMunity events, PawTime cards, Dog Park reviews, Lost reports, business reviews, and map pins.

4.6 PawFile is for your dog only. PawFile profiles must contain information and content relating to your dog only. No personal photographs of any person (including yourself) in a PawFile; no human PII in PawFile fields. Violations result in content removal and may lead to further account action.

4.7 Accurate dog profile information. You must provide accurate and truthful information about your dog's temperament, health, and behaviour. The PawRadar status ring (Green = friendly / Yellow = training, do not disturb / Red = not friendly / unset) must be set honestly — knowingly marking an aggressive dog "Green" to attract meet-ups is a material violation of these Terms.

5. Prohibited Conduct

You agree not to use the Services to engage in any of the following:

6. PawMate, PawMatch & PawRadar 2.0 Social / Map Features

6.1 Discovery. PawMatch shows dogs within 50 km radius active within the past 29 days, in randomised batches of 10 cards.

6.2 Usage limits. Non-PawVIP: 5 PawMates + pending combined. PawVIP: unlimited.

6.3 PawRadar 2.0 location & map. PawRadar (MapBox-powered in v2.0) displays nearby dogs, businesses, dog parks, transport routes, pet-friendly venues, and approved lost-dog reports on a multi-layer map.

6.4 Background location for Walk / Hike. Only while you have actively started a session. See Section 9 and Privacy Policy Section 11.2.

6.5 Blocking. Block any user; they cannot contact you, view your profile, send PawMate requests, send PawMail, react to your posts, comment on your posts, or RSVP to your events.

6.6 Offline meetings. PocketPaw does not conduct identity, background, or criminal record checks. Meet only in public, well-populated locations.

6.7 Dog injury disclaimer. When your dog meets other dogs (via PawMate, PawMunity event, Dog Park, business visit, or otherwise), you are solely and entirely responsible for assessing your dog's temperament, controlling its conduct, and any injury caused. PocketPaw expressly disclaims all liability.

6.8 Reporting. You may report any user, post, comment, reaction, event, business, product, dog park review, PawTime card, map pin, or PawFile.

7. PawBark Messaging

7.1 Eligibility. Between accepted PawMates; in v2.0, also with bookmarked PawPRO / PawPRO+ merchants (subject to merchant opt-in).

7.2 Limits. Non-VIP: 5 messages/day to other dog owners (Firestore atomic transaction). VIP: unlimited. Resets at UTC midnight.

7.3 Text only. PawBark supports text messages only in v2.0. No images, videos, or files.

7.4 Your responsibility. All messages must comply with these Terms and our Community Guidelines. We do not pre-screen but may review on report.

7.5 Privacy warning. Don't share sensitive PII via PawBark. PocketPaw is not responsible for information you voluntarily disclose to other users.

8. PawHeart (Adopt, Rehome & Lost)

8.1 Pure-intermediary platform. PocketPaw provides PawHeart as a free informational channel. We do not screen, verify, vouch for, or guarantee any listing, listing party, or any adoption arrangement. Adoption arrangements are made directly between the listing party and the adopter, at their own risk. Always verify independently and use the in-app "Report scam" affordance if you see anything suspicious.

8.2 Adopt tab. Adoptable dog listings may only be posted by verified NGOs and animal shelters through their designated NGO accounts.

8.3 Rehome tab (v2.0 update — PawVIP-only). - Posting is restricted to PawVIP subscribers (anti-spam measure introduced in v2.0). Want-to-Adopt text-only posts remain open to all users. - No animal sales — strict prohibition (Section 5). - One active post per user, with up to 5 photos. - 30-day expiry. - Accuracy — truthful health, behaviour, care information. - Local regulations — your responsibility (animal-welfare laws, transfer regulations, breed-specific legislation, municipal by-laws).

8.4 Lost tab — self-serve. Submit a Lost report from within the app via the form (forced square-crop photo, MapBox-backed location picker). Submissions enter the LostPending admin queue and, once approved, appear as coral-ringed pins on PawRadar. The email channel lost@pocketpawapp.com remains available as a fallback. PocketPaw broadcasts verified lost-dog cases free of charge. False or misleading reports may result in account suspension.

9. PawHub (Including Walk / Hike GPS Tracking)

9.1 Purpose. Personal health and exercise tracker for your dog. Includes Document storage (vaccinations, vet receipts, chip no.), Growth Marks (formerly Time Capsule), Dates, Health (weight, water intake), MyPicks (PawPicks selections), and Exercise (Walk / Hike + Companion Time).

9.2 Microchip number. Optional. Stored securely; not shared publicly except as required by law or as PawAdvisor AI context.

9.3 Health data accuracy. Self-reported; not verified by PocketPaw. PawHub is not a medical or veterinary record.

9.4 Documents. File contents are not read by PocketPaw or any AI service; only metadata is used.

9.5 Growth Marks. 1 photo every 180 days, edit once after upload.

9.6 Walk / Hike GPS tracking. - Manual start required. Tracking only while a session is active. - Background location use with compressed polyline, distance, duration, reverse-geocoded location name, static map thumbnail. iOS shows a blue background-location indicator. - Dog calorie estimates. weight_kg × distance_km × multiplier (0.85 walk / 1.20 hike). Illustrative only — not veterinary or nutritional advice. - Auto-stop after a configured maximum duration, with a 10-minute warning local notification. - Safety reminder. Comply with local leash laws, traffic, weather, terrain, your dog's condition. Do not use your phone in a way that endangers anyone. - Privacy. Walk / Hike records are visible only to you.

9.7 Exercise dashboard. PawHub Exercise surfaces an aggregate dashboard (distance, total time, session count, mental·physical split for Companion Time) filterable by Today / Last 7 days / This month / All time. Dashboards compute client-side from a single bounded fetch so switching periods is fast and free.

10. PawPicks

10.1 Purpose. Community-driven product database and review system.

10.2 Product listing data (community resource). When you submit a new product listing (name, brand, category, images, region, structured nutrition), you acknowledge and agree that this product listing data becomes part of PocketPaw's community database. You irrevocably assign to PocketPaw all rights, title, and interest in product listing data you contribute, or alternatively grant PocketPaw a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence for any purpose, including operation, promotion, display on pocketpawapp.com, analysis, and research. Product listing data is not deleted on account deletion because it forms part of the shared community resource.

10.3 Reviews (user ownership). You retain ownership; you grant a non-exclusive, worldwide, royalty-free, sublicensable, transferable licence for service operation. Reviews are anonymised (not deleted) within 30 days of account deletion.

10.4 No verification. Product information is NOT verified by PocketPaw. We disclaim liability for reliance.

10.5 Community moderation. Auto-takedown at ≥3 disagrees or duplicate flags; verification clears at ≥3 reviews.

10.6 Product Analytics & User Insights (PawVIP). Aggregated, anonymised; never identifies individual users.

10.7 No sale of data. No selling / renting / trading of personal data or usage data.

10.8 Tier border. Silver / gold border on product cards based on the creator's PawPRO tier. Tier indicator only — not an endorsement.

11. PawAdvisor (AI Assistant + Insight)

11.1 Service. PawAdvisor is a PawVIP-exclusive AI assistant powered by Google Vertex AI / Gemini 2.5 Flash. Two surfaces: - PawAdvisor Chat — interactive Q&A. - PawAdvisor Insight — periodic AI-generated summary surfaced in-app.

PawAdvisor is NOT operated, controlled, or monitored by PocketPaw in real time.

11.2 AI-generated content. PocketPaw does not review, verify, edit, endorse, or take responsibility for any AI output. AI responses may be inaccurate, outdated, incomplete, or inappropriate. Independently verify before acting.

11.3 Not professional advice. PawAdvisor does NOT provide veterinary, medical, nutritional, behavioural, or any other professional advice. Contact a veterinarian for emergencies.

11.4 Data sent to AI provider. Per turn: PawFile; PawHub data (chip, water, weight history last 20, vaccination records last 20, document metadata up to 30 items, capsule count only, upcoming dates); PawPicks food picks (brand + name + community rating + structured nutrition) and toy picks; last 10 messages in the conversation. File contents, photos, and your personal email / password are never sent to the AI.

11.5 Cross-border data transfer. AI processing may occur on servers in the United States or elsewhere globally. SCCs in our data processing agreement with Google.

11.6 Disclaimer acknowledgement. Required each time you open PawAdvisor.

11.7 Limitation of liability for AI. PocketPaw disclaims all liability for AI use / reliance. Your sole remedy is to discontinue use.

12. PawMunity (Forum, Reactions, Events, Search, Leaderboards)

12.1 Hub structure. PawMunity has three inner tabs: PawPicks, Forum, and Events.

12.2 Forum posting. - 1 post per UTC day per user (server-enforced); comments unlimited. - Optional title (≤120 chars), body (≤4,000 chars), up to 3 images @ 10 MB each. - Boards: region-scoped (HK / CA in v2.0; future v3 regions) and breed-scoped (40 canonical breeds, plus Main and Event boards per region). - Server derives board ID from your region, board type, and breed; client cannot tamper with namespace.

12.3 Reactions. Posts and comments support two reaction types — ❤️ "support" and ❓ "reservation" — one per user per post or comment. Reaction counts are aggregated via server triggers.

12.4 Forum search. Posts are indexed by automatically derived search tokens (lowercased title + body words) to enable in-app search. Hidden-keyword-stuffing for search manipulation is a violation of Section 5.

12.5 Board covers. Board cover images are managed via the setPawMunityBoardCover callable (admin / moderator).

12.6 Leaderboards. PawMunity surfaces weekly and monthly leaderboards (e.g. most-walked dog, most-friends, most-active breed board), recomputed by a scheduled job. Manipulating leaderboard rankings via fake walks, sock puppets, or coordinated boosting is a serious violation of these Terms.

12.7 Event creation & RSVP. - 2 event series per ISO week per user. A series is one single event OR one recurring set. - Recurring frequencies: weekly / biweekly / monthly; max 12 instances per series. - Optional breed scope (40 canonical breeds) and size scope (small / medium / large / extra-large). Empty = open to all. - Optional capacity with atomic capacity check on RSVP. - One-on-one events: capacity locked to 1; optional gender preference (any / same / opposite); gender match server-enforced. - Optional venue coordinates visible only to organiser and confirmed RSVP'd attendees. - 24h reminder push to "joined" attendees. - Organiser cancel: single instance OR full series; attendees are notified.

12.8 Two-tier moderation. - Region moderators — region-wide scope (HK or CA); elected annually via PocketPaw's official Instagram poll; assigned by PocketPaw admin. May delete posts / comments, mute / ban (pawMunityMuteUser / pawMunityUnmuteUser), and edit posts (updatePawMunityPost) within their region. - Breed-board moderators (板主) — breed-board-specific scope; elected via the same annual Instagram poll; may delete posts and comments only within their assigned breed board. - Moderators are forum-only, region-locked, and NOT general PocketPaw admins. They must apply these Terms and our Community Guidelines fairly and impartially; conflict of interest, retaliation, or favouritism is grounds for removal. Moderators may not use their role for commercial gain. - PocketPaw admin retains final authority and may act across any board globally.

12.9 Auto-takedown. ≥3 reports → post / event / comment auto-hidden pending admin or moderator review.

12.10 User content licence. PawMunity posts, comments, reactions, and event listings are User Content governed by Section 4.

12.11 Offline conduct. Sections 6.6–6.8 apply equally to in-person meetings arranged via PawMunity events.

13. PawTime & Companion Time

13.1 Purpose. Community-shared activity-card library accessible from PawMate. "+" on a card writes a CompanionSession feeding PawHub → Exercise → Companion Time.

13.2 Card definitions. Community-shared content. By suggesting or rating a card, you grant PocketPaw a perpetual, royalty-free licence to use, reproduce, modify, and display. Card definitions are not anonymised on account deletion.

13.3 Quota. 1 new card creation per UTC day (admins bypass).

13.4 Moderation. ≥3 reports → card auto-takedown.

13.5 Trend notifications. Push notification when your tracked exercise minutes drop ≥50% over 3 or 7 days. Wellness reminder — not medical advice.

14. PawMail

14.1 Purpose. Send a friendly paw-print / treat / heart "mail" to a PawMate.

14.2 Limits. 1 send per user per UTC day, server-enforced.

14.3 Opt-out. Settings → allowPawMail.

14.4 No content. Pre-defined items only; no free-text attachment.

15. Referral Programme

15.1 How it works. Share your unique referral code (visible in Settings). When a referred user creates an account and subsequently becomes your PawMate via a mutual match, both accounts receive bonus PawVIP time as configured by PocketPaw.

15.2 Bonus PawVIP source. Referral-granted PawVIP time is recorded as a referral source on your subscription record (Section 3.3) and may be combined with any active Apple / Google / Stripe / manual entitlement. Referral bonus expiry is tracked separately and persists across account devices.

15.3 Abuse. Self-referral (creating a second account to refer yourself), sock-puppet accounts, fake PawMates, coordinated referral boosting, and any other manipulation of the Referral programme are strictly prohibited and may result in revocation of bonus PawVIP, suspension, or permanent ban.

15.4 Changes. We may modify or end the Referral programme at any time, with reasonable advance notice. Bonus time already granted remains valid for its original duration.

16. Dog Parks Community

16.1 Purpose. PawRadar 2.0 surfaces community-curated dog parks. You may review parks (star + sub-ratings), favourite parks (shown on your PawFile), and contribute visit data which feeds an anonymised hourly-traffic chart for each park.

16.2 Review standards. Same as Section 10 — honest, based on personal experience, no spam / advertising / coordinated manipulation.

16.3 Visit data. Visits are recorded with 24-hour atomic deduplication and aggregated into the hourly-traffic chart. No individual visitor identity is exposed to other users.

16.4 Map-pin abuse. Misuse of map pins (e.g., pinning private property, false parks, harassment via location) may be reported via the in-app affordance and is grounds for content removal and account action.

17. PawVIP, PawPRO & PawPRO+ Subscriptions

17.1 PawVIP (consumer). Monthly USD $4.99 / Annual USD $49.99 in v2.0. Benefits: unlimited PawMates and PawBark, PawAdvisor (chat + Insight), PawPicks Product Analytics and User Insights, PawVIP crown badge, and PawHeart Rehome posting (new in v2.0; Want-to-Adopt text posts remain open to all). No daily usage limits across the app.

17.2 PawPRO & PawPRO+ (business / service provider) — Phase 2.

Tier feature inclusion is described in the in-app upgrade screen. Active Dashboard is PawPRO+ only (~5-min refresh; not real-time).

17.3 Payment processing. Apple StoreKit 2 on iOS in v2.0. Google Play Billing (Android) and Stripe (Web) when those platforms launch in v3. PocketPaw does not store card data.

17.4 Auto-renewal. Subscriptions auto-renew unless cancelled ≥24h before renewal. Cancel via your Apple ID > Subscriptions in device Settings (iOS), or via the corresponding account dashboard on Android / Web when those platforms ship.

17.5 Refunds. Final and non-refundable except per Apple policy (and, in v3, Google Play / Stripe policies) or applicable consumer protection law (Canada Consumer Protection Act; Quebec Consumer Protection Act; HK Sale of Goods Act; UK Consumer Rights Act 2015; Australian Consumer Law; NZ CGA; Singapore CPFTA; Malaysia CPA 1999; Japan Consumer Contract Act; Taiwan Consumer Protection Act; US state laws).

17.6 Price changes. ≥30 days' notice of material increases.

17.7 Downgrade. Existing PawMate, PawBark history, PawMunity content, and PawHub records remain intact; usage limits revert to non-VIP levels. For Business accounts, the map pin reverts to Free Pin appearance and PawPRO/PRO+-only features (e.g. Active Dashboard, full photo gallery, announcement push) are disabled.

17.8 Cross-platform entitlement recognition. See Section 3. The latest active source is honoured; cross-platform purchases do not stack durations (a one-month iOS subscription does not extend a concurrent one-year Stripe subscription). Manual grants and referral bonuses are additive on top.

17.9 Founding Merchant Offer. Not executing in v2.0 (Phase 2).

18. Business / Service Provider Accounts (PawPRO / PawPRO+)

18.1 Eligibility. Vets, groomers, dog walkers, pet shops, dog cafés, boarding facilities, daycares, dog trainers, dog sitters, online stores, NGO shelters, and similar dog-related businesses lawfully operating in their jurisdiction.

18.2 Pre-seeded pins & claim. Pre-seeded Free Pins may exist for businesses publicly identified in a launch region. Rightful operators may Claim This Business in the app, verified manually via phone / business registration / in-store photo. Approval is not guaranteed.

18.3 Accuracy. Profile must be accurate, current, and lawful. Misrepresentation → immediate termination.

18.4 Reviews. No pressuring, incentivising, or paying for reviews; no retaliation against reviewers; professional replies only (no personal attacks).

18.5 Push announcements. - PawPRO: max 2 per month. - PawPRO+: max 4 per month. - Per-user opt-out via PawBark or by removing the bookmark. - ≥50% unsubscribe over 3 consecutive months → written warning. Repeated breach → announcement suspension or account termination.

18.6 Analytics. Aggregated, anonymised only. No individual visitor or reviewer identities. Active Dashboard (PawPRO+) refreshes ~5 min — not real-time.

18.7 No vet-specific health data push. Even vet PawPRO/PRO+ accounts will not receive individual user health data, vaccination records, weight history, or other PawHub data.

18.8 Address changes. Via in-app form; MapBox forward geocoding for verification; admin approval.

18.9 Suspension for cause. Violations, fraudulent info, repeated cap breach, bad-faith refusal to honour bookings / promo codes / stamp cards, or any action damaging the platform.

18.10 Consumer protection. Nothing limits consumers' rights under applicable law.

19.1 App Intents (iOS 26+). PocketPaw exposes a limited set of App Intents for activation via Siri, Spotlight, Shortcuts, Apple Watch, and Apple Intelligence: start a Walk / start a Hike; stop the current walk / hike; open a section (PawRadar, PawMunity, PawMate, PawHub). Apple's voice / agent layers process voice input under Apple's own privacy policy.

19.2 Confirmation for sensitive actions. Destructive, public, or paid actions (subscribe, public forum post, accept PawMate) require explicit confirmation in-app. Assistants and agents may not commit such actions silently.

19.3 Deep links. Universal links under pocketpawapp.com (e.g. /paw/{id}, /business/{id}, /product/{id}) open in-app if installed. Custom-scheme links under pocketpaw:// (e.g. pocketpaw://walk/start?type=hike, pocketpaw://open/pawhub) are used by App Intents and Shortcuts. Standard authentication still applies to private surfaces.

19.4 Cross-platform parity (Android, future v3). Equivalent App Actions / App Functions for Google's Gemini assistant, with matching pocketpaw:// deep-link semantics, will be implemented when the Android app ships.

19.5 No cloud-agent silent writes. External cloud agents may not invoke our backend without an authenticated user session. Until we publish an authenticated agent API (with rate-limiting and abuse protection), only on-device assistants (Siri / Apple Intelligence / Gemini on-device) may invoke App Intents.

20. Intellectual Property

20.1 Our rights. The PocketPaw, PawRadar, PawMate, PawBark, PawHeart, PawHub, PawPicks, PawAdvisor, PawMunity, PawTime, PawVIP, PawPRO, PawPRO+, PawMail, Growth Marks and other brand identifiers, logos, design, text, graphics, software, and compilation are owned by or licensed to NextPath Solutions Limited. No copying / modifying / distributing / selling without consent.

20.2 Feedback. Irrevocable, perpetual, royalty-free licence to use, without compensation.

20.3 Copyright complaints. Contact support@nextpath.hk. DMCA-conformant elements (17 U.S.C. § 512(c)(3)) for US complaints.

21. Third-Party Services

The Services rely on: - Google LLC (Firebase) — auth, Firestore, storage, cloud functions, Cloud Scheduler, FCM, analytics, crash reporting. - Google LLC (Vertex AI / Gemini) — PawAdvisor chat and Insight. - MapBox, Inc. — PawRadar 2.0 tiles, geocoding, location picker, Walk / Hike static thumbnail rendering. - Apple Inc. — App Store, IAP (StoreKit 2), App Store Server Notifications V2, APNs push, Sign in with Apple, legacy Apple Maps, App Intents framework. - Google Play & Google Sign-In (Android, v3). - Stripe, Inc. (Web business backend, v3).

22. Disclaimers

22.1 As-is. Services provided "as is" and "as available" without warranties.

22.2 No professional advice. No veterinary / medical / legal / financial / professional advice.

22.3 User conduct. No pre-screening; not responsible for users' online or offline conduct.

22.4 Service availability. No guarantee of uninterrupted, secure, error-free Services.

22.5 Location accuracy. GPS approximate. Walk / Hike distance and dog-calorie estimates illustrative only.

22.6 Platform purpose. Exclusively for dogs, owners, and businesses that serve them. Not a general human social network.

22.7 Platform neutrality. Neutral platform; no endorsement of any user, dog, NGO, shelter, business, dog park, or product.

22.8 Scam awareness. No pre-screening of messages / PawMail / PawMunity / PawHeart. PocketPaw will never request money or financial information via in-app messages. Report scams: safety@nextpath.hk or in-app Report.

22.9 Breed-specific legislation & local by-laws. Your responsibility.

22.10 AI content disclaimer. See Section 11.

22.11 User-generated product / dog-park / business information. Not verified.

22.12 PawHub health tracking & Walk / Hike estimates. Not a medical record. Estimates are simplified models and may be inaccurate.

22.13 Business profile information. Maintained by the merchant. PocketPaw does not verify menu pricing, hours, service quality, licences, or insurance. Transactions are between you and the merchant.

22.14 Active Dashboard. ~5-minute refresh. Not a real-time feed.

22.15 Leaderboards. Leaderboard rankings reflect computed metrics over a defined period and are recomputed periodically; they are not endorsements of any user, dog, or board.

22.16 PawAdvisor Insight. The Insight summary is an AI-generated wellness reflection; it is not medical or veterinary advice and should not be relied upon for clinical decisions.

23. Limitation of Liability

23.1 Exclusion of consequential damages. To the fullest extent permitted by law, NextPath Solutions Limited and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, revenue, goodwill, or other intangible losses, arising from access / use / inability to use; conduct of users; User Content; unauthorised account access; or any other matter relating to the Services.

23.2 Liability cap (consumer). Greater of: (a) fees paid in the 12 months preceding the claim; or (b) HKD 800.

23.3 Liability cap (Business / Service Provider). Greater of: (a) subscription fees paid in 12 months; or (b) HKD 5,000.

23.4 Consumer rights. Nothing limits mandatory consumer protection (Canada CPA, Quebec consumer law, HK Sale of Goods Act, Australian Consumer Law, NZ CGA, UK CRA 2015, US state laws, Singapore CPFTA, Malaysia CPA 1999, Japan Consumer Contract Act, Taiwan Consumer Protection Act).

24. Indemnification

To the maximum extent permitted by law, you indemnify NextPath Solutions Limited, its affiliates, directors, officers, employees, and agents from claims arising out of: (a) your use of the Services; (b) your User Content; (c) your breach of these Terms; (d) third-party rights violations; or (e) for Business accounts, your products / services, business operations, and any consumer or regulatory claims arising from transactions with PocketPaw users.

25. Termination

25.1 By us. Suspension or termination at our discretion for violations, harmful conduct, or safety / integrity reasons.

25.2 By you. Delete your account in Settings; data deleted within 30 days, except where retention is legally required.

25.3 Effect. Access ceases; PawVIP / PawPRO / PRO+ subscriptions not refunded unless required; User Content licences terminate after removal, subject to backup, caching, and community-archive timelines.

25.4 Survival. Sections 4.2, 9, 10.2, 11, 13.2, 17.5, 20, 22, 23, 24, 26, 27 survive.

26. Governing Law & Dispute Resolution

26.1 Governing law. Hong Kong SAR law.

26.2 Jurisdiction. Non-exclusive jurisdiction of HK courts.

26.3 Informal resolution. Contact support@nextpath.hk; 30-day informal resolution effort.

26.4 Consumer rights. Mandatory consumer protection in your jurisdiction is preserved (EU / UK / Canada / Quebec / Australia / NZ / Singapore / Malaysia / Japan / Taiwan / US states — applicable in current or future markets).

27. General Provisions

27.1 Severability. Invalid provisions severed; remainder remains in force.

27.2 Entire agreement. These Terms (Version 2.0) + Privacy Policy (Version 2.0) + Community Guidelines (Version 2.0).

27.3 No waiver.

27.4 Assignment. You may not assign without consent; we may assign without restriction.

27.5 Force majeure. Not liable for delays beyond reasonable control.

27.6 Language. Drafted in English. Translations into 繁體中文, Français, Українська, தமிழ், 日本語, and Bahasa Melayu are provided for convenience only. English prevails in conflict, except where local mandatory law requires otherwise (e.g., Quebec French).

27.7 Notices. In-app notification, email to your registered address, or website posting. Notices to us: support@nextpath.hk.

If you do not agree to the updated Terms, you must stop using the Services and may delete your account.

These Terms of Service (Version 2.0) were reviewed by NextPath Solutions Limited's legal team on 23 May 2026 in connection with the PocketPaw v2.0 product release (PawMunity with reactions / search / leaderboards, two-tier moderation, PawPRO / PawRadar 2.0, Walk / Hike GPS, PawTime, PawMail, Growth Marks rename, Referrals, multi-platform sync prep). This document is intended for general informational and contractual purposes and does not constitute legal advice. Specific situations may vary; enterprise and commercial partners should seek independent legal advice.
